Domain Name Term of Use
Customer registering any domain name through Octopus Hosting Network must read and agree Octopus Hosting Network terms of use and also terms of use given by Domain Registrar from which domain is registered. Domain name includes all TLDs (Top Level Domains i.e .com, .net. org, etc.), SLDs (Second Level Domains), gTLD – Generic TOP Level Domains, ccTLD – Country Code Top Level Domain (e.g domains under .PK etc.). Customer is fully responsiblle and liable for any illegal content or activity on domain name that violates Pakistan’s law or any other country’s law. Octopus Hosting Network is not liable or held responsible for any such violation by customer registering domain name. Octopus Hosting Network reserves the right to suspend domain name or cancel customer’s access to domain name when Octopus Hosting Network decides that the domain name is violating Octopus Hosting Network terms of use or terms of use given by Domain Registrar from which domain is registered . Web Hosting Term of Use
Octopus Hosting Network reserves the right to suspend or cancel a customer’s access to any or all services provided by Octopus Hosting Network when Octopus Hosting Network decides that the account has been inappropriately used or otherwise.
SERVER USE
Octopus Hosting Network reserves the right to refuse service and / or access to its servers to anyone. Octopus Hosting Network does not allow to host contents or links promoting any religion or sect. Following contents are also not allowed to host.

SPAM – Octopus Hosting Network has zero tolerance for UBE/UCE (unsolicited bulk email/unsolicited commercial email). This policy protects our customers as well as the internet community from the negative effects of “spam” related activity. We defines UBE/UCE as unsolicited broadcast or commercial email that is sent to addresses that do not affirmatively and verifiably request such material from that specific sender. We defines spam as any type of unsolicited email used for any purpose. Any unsolicited e-mail being sent will result in suspension or termination of the offending account. We take a zero tolerance stance against sending of unsolicited e-mail and other forms of spam.

Email Usage Limits:
There is a 125 outgoing email hourly limit per domain. This limit is also applied towards MAILING Lists also. If you send over this amount in any hour, most of the e-mails will bounce back with an undeliverable error. If this occurs, it will then take some time for your account to be able to send again so we recommend waiting at least 1 hour after this issue occurs to begin sending email again.
CONTENT OF WEBSITES::

The customer agrees to indemnify and hold harmless Octopus Hosting Network from any claims resulting from the use of our services.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder or host any type of religious content will result in the immediate termination of your account. When a website is found to be monopolizing the resources available Octopus Hosting Network reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.
User may not:
While our shared services are suitable for the bulk of our customers, there comes a time for some websites when they are better suited for a larger plan, which allows for more dedicated CPU and memory resources. We reserve the right, in our sole discretion, to discontinue service to any customer with a website or other hosted data that takes up more than 10% of the server resources and / or 10% of the server’s CPU.
This means that if your website is found to be utilizing more than 10% of the CPU and memory of the service, we reserve the right to take your site offline. If this becomes necessary, you can either upgrade your hosting package, or request a pro-rated refund of the amounts you have paid in advance for the services. Due to the severity of this, and our ability to act quickly to correct these situations to avoid server issues, we will do everything reasonably feasible to provide you with a warning prior to taking your site offline, but we accept no obligation to do so.
When the Services Will be Available?
We will attempt to provide the services 24 hours a day, 7 days a week for as long as you have paid for them. Sometimes, however, for a number of reasons, the services may be unavailable to you. You must recognize and acknowledge that due to the nature of web hosting technology, occasional unavailability of the services cannot be avoided. Sometimes there are equipment malfunctions. At other times we undertake periodic maintenance procedures or repairs. Still other times, there are causes beyond our control like power failures, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network traffic and other occurrences. We have not promised to provide you with uninterrupted service.
REFUNDS
All Web Hosting plans include 15 day money back guarantee. If you are dissatisfied with our service and we are not able to provide what we promised, you will receive a full refund in case of hosting service only. .
Any request for cancellation must be received via the web form, E-mail and you will receive a confirmation upon the cancellation of your account. No refunds are available after 15 days.
In case of Free domain Registratiion, All refunds are subject to a domain registration fee charge; however upon payment of such charge you will have the opportunity to continue to register and renew registration of your domain name after cancellation of your hosting account.
In case of Terms Violation
Accounts cancelled/terminated by Octopus Hosting Network for violating our Terms of Use do not qualify for the 15-day money back guarantee. For example, if your account is cancelled due to spamming, you will not be given any refund.
Customer refund requests are to be sent via email or phone within 15 days from service purchase date and will only be processed in the cases of service non-performance or corruption that might be caused by Octopus Hosting Network’s side, Refund requests will not be accepted if it’s requested for any cause that’s out of Octopus Hosting Network’s side, For example:

Octopus Hosting Network will not be responsible for any damages your business may suffer. Octopus Hosting Network makes no warranties of any kind, expressed or implied for services we provide. Octopus Hosting Network disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by Octopus Hosting Network and its employees. We strongly recommend all of our customers to do their own backups of website files, database & emails to ensure they have ready access to their data in the event we should have a hardware failure. Though we do not expect anything like this to occur, we want you to be prepared in the event that it does. Octopus Hosting Network reserves the right to revise its policies at any time.
Octopus Hosting Network also reserves the right to cancel your account with 24 hours notice should an event occur in which proper evidence exists that a customer was exceptionally rude or vulgar in communications with our staff.

PKNIC Policy
Any applicant who wants to register a domain name under .PK must read and agree to the PKNIC policy posted here. The PKNIC policy for the domain names is subject to enhancements and modifications driven by the PKNIC Policy Group, that seeks to devise .PK policies that are equitable and fair to all affected Internet stakeholders, including PKNIC. The PKNIC Policy Group is comprised of the members and observers from the Internet Community and those with vested interest towards the betterment of the Internet stakeholders for .PK domains.
Background
The original PKNIC policy was based on INTERNIC Domain Name policies with some modifications borrowed from relevant NICs around the world. Previously the PKNIC policy was subject to modification by a large PKNIC Advisory Group, who voted to introduce substantial changes to the PKNC policy (the record of the voting results is available offline).
Exclusions and Overriding principle
The general text of PKNIC policy are supplemented (and in the case of conflict) superceded by specific terms and conditions for specific services (e.g. domain registration Sunrise, name.pk land rush, etc.). The details about payment rates, renewal, expiration, redemption, etc are given in separate schedules. The PKNIC Advisory Group has been replaced by the new PKNIC Policy Group, and all reference to the PKNIC Advisory Group functions in the current PKNIC Policy text below will be performed by the PKNIC Policy Group.
PKNIC – Internet Domain Registration Policy
Policy Version 4.3 adopted after the 28th July 2016 meeting of the PKNIC Policy Advisory Group.
The applicant who wants to register a domain name under .PK is presumed to have read and agreed to this PKNIC Internet Domain Registration Policy, stated below and any subsequent changes as and when placed on the PKNIC website. Applicants and owners of the Domain Names are responsible to read the updates on the PKNIC website frequently and deemed to have notice of any subsequent changes which the applicant hereby agrees to.
I, the applicant/registrant, hereby agree that any controversy, claim or dispute arising out of, relating to or in connection with my application to register, my registration of, or my use or misuse of a “.pk” domain name and continued listing service by PKNIC for that domain, shall be finally settled by way of binding arbitration under the rules of the Domain Name Dispute Resolution Center (“DNDRC”) (www.dndrc.com), and the PKNIC process for Domain Dispute Resolution , both of which are primarily based upon the Uniform Domain Name Dispute Resolution Policy (As Approved by ICANN on October 24, 1999) and/or the Rules for Uniform Domain Name Dispute Resolution Policy (As Approved by ICANN on October 24, 1999). The arbitral panel appointed by the DNDRC shall have the power to rule on their own jurisdiction, including any objections with respect to the existence, scope or validity of the arbitration agreement. PKNIC shall implement decisions of DNDRC with respect to those decisions where there is no material deviation with DNDRC’s Rules, PKNIC’s Dispute Resolution Process, and are consistent with applicable arbitration law.
